1.In all cases, the Consultant warrants that he has
requisite authority from the Client to obtain & collate information
in relation to:heating,
cooling and ventilation systems hot water system lighting building
age, construction details and levels of insulation building dimensions
(internal) windows
that relate to the property.
2. That the Client shall ensure that the Consultant is afforded proper
and timely access to all parts ofthe property required for the proper
completion ofthe EPC and the report.Within five days ofthe survey
being completed by the Consultant, the Consultant will forward to
the Accrediting body the required documentation for the registration
ofthe EPC and report.
3.Upon the return of the EPC and the report from the accrediting body.
The Consultant will notify the client that the EPC and report are
available. At the same time the Consultant will forward the invoice
for the agreed amount.
4.The Client will make payment to the Consultant within 28 days. The
Consultant will send to the Client, the EPC and report, within three
days of payment.
5.Neither party shall be liable to the other, under contract or otherwise,
for consequential or indirect loss or damage of any nature whatsoever.
Neither party shall be liable to the other for any failure in the
fulfilment of its obligations under this agreement to the extent that
such failure is beyond the reasonable control of the affected party.
6.Either party shall terminate this agreement upon giving 28 days
notice, subject to payment for all work to date
